Privacy and security principles must permeate any aspect of the healthcare industry where health information is found. Every day, privacy and security officers balance confidentiality issues of health reform, technology advances, and workflow accommodations. Programs face complexities of regulatory disparity, portability, speed of information transfer and now the emerging American Recovery and Reinvestment Act (ARRA). Consumer trust issues abound in this environment of information pervasiveness, lacking industry standards, and ungoverned health information handlers, seekers, and secondary databases. Participants will mix with a supportive peer group, placing the learning experience into a practical framework as program recommendations are investigated for breach notification management, the Red Flag Rules, and ARRA integration. Participate if you are seeking the CHPS credential and wish to advance your knowledge to meet privacy and security professional requirements.
CEU’s: 6
Learning Level: 4 Advanced
Learning Category: Privacy, Confidentiality and Security. Compliance, Regulations and Accreditation
| 8:30–8:45 a.m. | Welcome and Introductions |
| 8:45–9:45 a.m. | The Red Flag Rules: Optimizing Consumer Protections and Regulatory Compliance The Red Flag Rules, implemented November 1, 2009, obligate compliance by healthcare providers. The FTC law impacts identify theft, medical identity theft, and overall consumer privacy rights. This session presents internal approach options for consumer protections and operations management. Rule compliance issues from registration portals and access management to how-to’s for working with a victim will be addressed. |
| 9:45–10 a.m. | Break |
| 10 a.m.–12 noon | Breach Management: Coping with Compliance Regulations Breach notification laws are in place in a majority of states, some with aggressive requirements difficult to decipher operationally. Add to that ARRA’s new stricter breach management ‘floor’ than HIPAA obligates, and it’s clear healthcare organizations must be proactive with well-planned breach management approaches to ensure appropriate and efficient victim contacts when a breach occurs. This session provides legal guidance on defining a breach, interpretation of notification laws, practical breach management approaches, and understanding enforcement and penalties.
|
| 12 noon–1 p.m. | Lunch |
| 1–2:30 p.m. | The American Recovery and Reinvestment Act (ARRA)—What Privacy and Security Officers Should Be Doing Now The privacy and security provisions of the American Recovery and Reinvestment Act of 2009 will roll out gradually over the next two to three years, calling for ongoing repositioning of privacy and security programs. This session will address how privacy and security leaders can proactively manage important aspects of ARRA today and anticipate future change as regulations and standards are drafted and finalized. Participants will learn to pace the changes and to bring the workforce along as the implementation evolves.
